{"id":4587,"date":"2018-05-30T23:44:44","date_gmt":"2018-05-30T23:44:44","guid":{"rendered":"https:\/\/jsis.washington.edu\/humanrights\/?p=4587"},"modified":"2024-04-30T14:51:19","modified_gmt":"2024-04-30T21:51:19","slug":"uwchr-celebrates-success-of-foia-lawsuit-against-cia","status":"publish","type":"post","link":"https:\/\/jsis.washington.edu\/humanrights\/2018\/05\/30\/uwchr-celebrates-success-of-foia-lawsuit-against-cia\/","title":{"rendered":"UWCHR Celebrates Success of FOIA Lawsuit Against CIA"},"content":{"rendered":"<p>[<a href=\"https:\/\/jsis.washington.edu\/humanrights\/2018\/06\/11\/uwchr-celebra-exito-de-demanda-contra-la-cia\/\">Espa\u00f1ol]<\/a><\/p>\n<p>Last week, after more than two years of discussions, the University of Washington settled its 2015 Freedom of Information lawsuit brought by the UWCHR against the CIA. <a href=\"https:\/\/www.seattletimes.com\/seattle-news\/uw-settles-suit-against-cia-over-data-on-salvadoran-army-officer\/\" target=\"_blank\" rel=\"noopener\">As reported by The Seattle Times,<\/a> the UWCHR\u2019s lawsuit resulted in the declassification of 139 documents regarding Sigifredo Ochoa P\u00e9rez, a former Salvadoran Army officer implicated in human rights violations, including the 1981 Santa Cruz massacre and the 1982 El Calabozo massacre. <strong>We are pleased with this outcome, and are continuing our work to further struggles for truth, justice, and accountability through <a href=\"https:\/\/jsis.washington.edu\/humanrights\/projects\/access-information-human-right\/\">access to information<\/a>.<\/strong><\/p>\n<h2>New Documents, New Information<\/h2>\n<p>The documents obtained through this lawsuit have already been useful for justice purposes. One CIA cable released as a result of UWCHR\u2019s lawsuit was <a href=\"https:\/\/jsis.washington.edu\/humanrights\/2018\/01\/24\/el-salvador-supreme-court-cites-cia-cable-published-uwchr\/\">cited by the Constitutional Chamber of the Supreme Court of El Salvador<\/a> in a 2017 ruling ordering a new investigation of the forced disappearance of children during an August 1982 military operation in the department of San Vicente. Others had been declassified pursuant to earlier requests, but were now released with fewer redactions. As part of our commitment to the right to truth, the UWCHR shares all the declassified documents we obtain with the general public, free of charge. <strong><a href=\"https:\/\/digital.lib.washington.edu\/researchworks\/handle\/1773\/38709\" target=\"_blank\" rel=\"noopener\">To access these records, visit the UW Libraries collection.<\/a><\/strong><\/p>\n<h2>Building the Case<\/h2>\n<p>The lawsuit against the CIA was the result of years of preparation, starting with the UWCHR\u2019s first FOIA requests in 2012. Since then, our <a href=\"https:\/\/jsis.washington.edu\/humanrights\/2018\/04\/03\/education-change-meet-uwchrs-student-foia-research-team\/\">undergraduate and graduate student researchers<\/a> have filed more than 500 requests to a wide range of federal and state agencies. <strong>In every case, our information requests are based on the strategic priorities of our partners on the front lines of human rights struggles at home and abroad.<\/strong><\/p>\n<p>In the case of the UWCHR\u2019s Unfinished Sentences project, those partners include organizations, communities, and individuals working for justice for crimes against humanity committed during the armed conflict in El Salvador. However, UWCHR researchers identified 20 previously-declassified CIA documents including information about Ochoa. Meanwhile, UWCHR continues our day-to-day work to bring about greater understanding of the human rights abuses committed during the armed conflict in El Salvador. Our team continues to file and monitor FOIA requests to the CIA and other agencies, to share the documents we obtain with partner organizations, and to contribute to evolving dialogues about truth, justice, and reparations for survivors of crimes against humanity.<\/p>\n<p><strong>Since 2016, the UWCHR has broadened its freedom of information research to include its new <a href=\"https:\/\/jsis.washington.edu\/humanrights\/projects\/human-rights-at-home\/\">\u201cHuman Rights at Home\u201d<\/a> project.<\/strong> Through a focus on immigrant rights in Washington state, researchers are using both the federal FOIA and state public records laws to examine the human rights implications of federal immigration enforcement. Working with partners including grassroots immigrant-led organizations and legal advocacy groups, our researchers have helped shed light on issues including <a href=\"https:\/\/jsis.washington.edu\/humanrights\/2018\/03\/22\/uwchr-sheds-light-border-patrol-immigration-checks-buses\/\">Border Patrol checks on buses<\/a>; <a href=\"https:\/\/jsis.washington.edu\/humanrights\/2017\/09\/25\/dont-ask-do-tell\/\">collaboration between local police and ICE<\/a>; and apparent <a href=\"https:\/\/jsis.washington.edu\/humanrights\/2018\/01\/17\/hands-off-maru\/\">retaliation by ICE against immigrant rights advocates<\/a> in our community.<\/p>\n<p><i>No state funds are employed in the UWCHR\u2019s litigation efforts.
