{"id":2375,"date":"2016-12-28T20:44:38","date_gmt":"2016-12-28T20:44:38","guid":{"rendered":"http:\/\/dev.jsis.washington.edu\/humanrights\/?page_id=2375"},"modified":"2026-06-24T12:11:31","modified_gmt":"2026-06-24T19:11:31","slug":"rethinking-punishment","status":"publish","type":"page","link":"https:\/\/jsis.washington.edu\/humanrights\/projects\/rethinking-punishment\/","title":{"rendered":"Rethinking Punishment"},"content":{"rendered":"<h1><strong>The Juvenile Parole Healing and Ready to Release Initiative<\/strong><\/h1>\n<p><strong>In the newest project under the Rethinking Punishment Initiative, Law, Societies, and Justice (LSJ) Faculty Katherine Beckett and Ann Frost as well as LSJ majors Brendan Lee and Elijah Tuncap are partnering with the Seattle Clemency Project to study the nature and causes of gaps in the juvenile parole process, and ways of mitigating these inequities.<\/strong><\/p>\n<p><a href=\"https:\/\/jsis.washington.edu\/humanrights\/wp-content\/uploads\/sites\/22\/2026\/06\/ISRB-Juvenile-Board-An-Assessment-with-Recommendations-for-Improvement_FINAL.pdf\"><strong>Read the final project report here.<\/strong><\/a><\/p>\n<p><span style=\"font-weight: 400\">In 2012, the U.S. Supreme Court held in <\/span><i><span style=\"font-weight: 400\">Miller v. Alabama<\/span><\/i><span style=\"font-weight: 400\"> that sentencing people to life in prison for crimes they committed as a child is unconstitutional. Since that time, Washington State has passed legislation allowing people who have served 20-25 years of a lengthy sentence for a crime they committed when they were a child to petition for release through the Indeterminate Sentencing Review Board (ISRB).\u00a0 Such individuals can also petition for clemency or seek Prosecutor-Initiated Resentencing (PIR) under SB 6164.\u00a0 However, the<\/span> <span style=\"font-weight: 400\">Department of Corrections (DOC) sometimes limits who can enroll in rehabilitative programming, with those with the longest sentences placed at the bottom of the waitlist. <\/span><b>As a result, many of those who are eligible for a second look are effectively shut out of prison programming due to their long sentences. <\/b><span style=\"font-weight: 400\">This has detrimental consequences for those petitioning (and possibly gaining) post-conviction relief with minimal, or any, rehabilitative programming under their belts.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Juvenile Parole Healing and Ready to Release Initiative will conduct research that will guide the Seattle Clemency Project and UW\u2019s work with Department of Corrections leadership and policymakers who are able to identify and enact changes to ensure that anyone who is eligible for a second look is able to pursue it.<\/span><\/p>\n<h1>Partners<\/h1>\n<div class=\"clear-sep\"><\/div>\n<\/div>\n<h1>Past Rethinking Punishment Projects<\/h1>\n<h2>Restorative Justice Project<\/h2>\n<p>UW faculty and students are researching alternatives to mass incarceration\u2014and working to implement them in Washington State. Programs based in restorative justice, which bring responsible parties and survivors together to repair the harms caused by crime, offer one such alternative. In June 2016, Prof. Katherine Beckett and law student Martina Kartman published a report, <em><a href=\"https:\/\/jsis.washington.edu\/humanrights\/wp-content\/uploads\/sites\/22\/2017\/02\/Restorative_Justice_Report_Beckett_Kartman_2016.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Violence, Mass Incarceration and Restorative Justice: Promising Possibilities<\/a><\/em>,\u00a0which describes and analyzes various restorative justice programs. Prof. Beckett and Kartman began implementing restorative justice circles based on these models at prisons at in Washington State in Spring 2017.<\/p>\n<p>Since 2017, this work has evolved into an independent organization, <a href=\"https:\/\/www.facebook.com\/collectivejusticenw\/\">Collective Justice<\/a>, with an institutional home at the <a href=\"http:\/\/www.defender.org\/\">Public Defender Association<\/a> in Seattle. Collective Justice works to \u201charness the collective power of communities to build new pathways of accountability and healing\u201d through an integrated program of\u00a0restorative and transformative justice projects involving incarcerated people, survivors of harm, and communities. <a href=\"https:\/\/jsis.washington.edu\/humanrights\/2020\/10\/28\/collective-justice\/\">Read more about Collective Justice&#8217;s work<\/a> in a discussion that took place during late Summer 2020.<\/p>\n<h2>Mixed Enrollment &amp; University Beyond Bars<\/h2>\n<p>In partnership with the <a href=\"https:\/\/lsj.washington.edu\/\">Law, Societies, and Justice<\/a>,\u00a0the Center for Human Rights helped launch\u00a0a unique mixed enrollment course led by Professor Steve Herbert, in which UW students study alongside prisoner participants in the University Beyond Bars program at Washington State Reformatory in Monroe, WA. Continuing support for this project\u00a0is generously provided by the <a href=\"https:\/\/lsj.washington.edu\/news\/2014\/09\/10\/endowed-fund-honors-memory-timothy-richard-wettack\" target=\"_blank\" rel=\"noopener noreferrer\">Timothy Richard Wettack Endowed Fund<\/a>.<\/p>\n<p><strong><a href=\"https:\/\/jsis.washington.edu\/humanrights\/tag\/mixed-enrollment\/\">Read news and student reflections from the mixed enrollment program.<\/a><\/strong><\/p>\n<h2>Rethinking Punishment Radio Project<\/h2>\n<p>In collaboration with\u00a0<strong><a href=\"https:\/\/citedpodcast.com\" target=\"_blank\" rel=\"noopener noreferrer\">Cited Podcast<\/a><\/strong>, the Rethinking Punishment Radio Project works to share the life stories of people who have served or are serving long prison sentences, and to provide sociological and historical context for contemporary criminal justice issues. These stories have been broadcast on <a href=\"http:\/\/kuow.org\/post\/how-one-tacoma-superpredator-turned-his-life-around\" target=\"_blank\" rel=\"noopener noreferrer\">KUOW<\/a> and over 100 campus and community radio stations in North America.<\/p>\n<p><strong><a href=\"https:\/\/citedpodcast.com\/2017\/09\/27\/55-the-story-behind-americas-mass-incarceration-experiment\/\">&#8220;The Story Behind America\u2019s Mass Incarceration Experiment&#8221;<\/a>:\u00a0<\/strong>In the late 1960s, criminologists like Todd Clear predicted America would soon start closing its prisons. They couldn\u2019t have been more wrong.\u00a0Dan Denvir from The Dig and Katherine Beckett from the University of Washington Center for Human Rights join Cited Podcast host Sam Fenn to tell the story of mass incarceration in America. They talk to Rutgers criminologist Todd Clear on what we\u2019ve learned from this \u201cgrand social experiment,\u201d poet Reginald Dwayne Betts about redemption and violent crime, and Larry Krasner, a progressive lawyer who has shaken up a DA\u2019s race in Philadelphia.<\/p>\n<p><strong><a href=\"https:\/\/citedpodcast.com\/2020\/04\/29\/exiled-a-year-in-new-yorks-infamous-sex-offender-motel-rebroadcast\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline\">&#8220;Exiled&#8221;<\/span><\/a>:\u00a0<\/strong>Sex offenders are the most reviled and abused criminals in\u00a0prison.
